Empower may, at its sole discretion, from time to time, offer referral awards for referring new Subscribers in specified geographic areas. When a referrer uses a referral code tied to a Subscriber account, any earned referral award automatically will be credited as subscription credit. When a referrer uses a referral code tied to a Consumer account, any referral award automatically will be credited as ride credit.
To qualify as a Subscriber referral, the referred account must belong to a new Subscriber who signed up in a geographical market offering a referral promotion at the time the referral code is entered by the new Subscriber. The new Subscriber must also enter the referrer's referral code prior to providing their first ride using Empower’s software.
The Standard Referral Award amount will equal the lesser of: (a) the subscription fees paid by the new Subscriber for the period beginning on the first day of their first paid subscription and ending 29 calendar days thereafter, or (b) the monthly subscription plan fee for the new Subscriber’s geographic market. In geographic markets with multiple monthly subscription plans, the monthly subscription plan fee for purposes of this paragraph shall equal the Monthly Platinum Subscription fee for the new Subscriber’s geographic market.
Referral awards are issued automatically 30 days after the new Subscriber starts their first paid subscription plan.
Empower may also offer Other or Additional Referral Awards for referring new Subscribers. Other or Additional Referral Awards shall be subject to these Terms and Conditions except and only to the extent the written terms of such Other or Additional Referral Award directly conflict with these Terms and Conditions.
Empower reserves the right to terminate, take back, eliminate, draw down, prevent the use of, or not make payment with respect to any referral award that Empower determines, in its sole discretion, was obtained or is being used in violation of any provision of the SaaS Agreement or Acceptable Use Policy, illegally, fraudulently, or through deceptive or manipulative means.
