Empower’s Software as a Service Agreement (the “SaaS Agreement”), which is entered into by all Empower subscribers, prohibits all illegal activity and includes zero tolerance policies with respect to operating a vehicle under the influence of drugs or alcohol, and engaging in any form of illegal discrimination while using Empower’s software and services. Any subscribers violating either of these policies are locked and cannot continue to use Empower’s services.
The SaaS Agreement specifically provides that “Customer agrees not to and agrees that it will not permit, cause or assist any third party to: . . . (iv) use the Services in violation of any applicable law, rule, or regulation or for any purpose not permitted in this Agreement; (v) post information or interact on the Empower Platform in a manner which is fraudulent, libelous, abusive, obscene, profane, sexually oriented, harassing, or illegal . . . (xv) provide Consumer Services while under the influence of alcohol or drugs, or
take any action that harms or threatens the health or safety of others.”
